Agreement

This Term of Use Agreement (“the “Agreement”) specifies the Terms and Conditions for access to and use of  this website (the “Site”) and describes the terms and conditions applicable to your access of and use of the Site. This Agreement may be modified at any time by Runwild Agency upon posting of the modified Agreement. Any such modifications shall be effective immediately.  Each use by you shall constitute and be deemed your unconditional acceptance of this Agreement.

 

Privacy

In addition, when using our Site, you shall be subject to any posted policies, guidelines or rules applicable to use of the Site and any service provided by the Site, including, but not limited to, our Privacy Policy. All such policies, guidelines and rules are hereby incorporated by reference into these Terms of Use.

 

Ownership

All content included on this site is and shall continue to be the property of Runwild Agency, LLC or its content suppliers and is protected under applicable copyright, patent, trademark, and other proprietary rights. Any copying, redistribution, use or publication by you of any such content or any part of the Site is prohibited, except as expressly permitted in this Agreement. Under no circumstances will you acquire any ownership rights or other interest in any content by or through your use of this Site.

 

Trademarks

You acknowledge Runwild Agency’s exclusive rights in its trademarks and service marks. Trademarks, service marks, logos, and copyrighted works appearing in this website are the property of Runwild Agency or the party that provided such intellectual property to the Site. Runwild Agency and any party that provides intellectual property to the Site retains all rights with respect to any of their respective intellectual property appearing in this website, and no rights in such materials are transferred or assigned to you.

 

Site use

Runwild Agency grants you a limited, revocable, nonexclusive license to use this site solely for your own personal use and not for republication, distribution, assignment, sublicense, sale, preparation of derivative works, or other use. You agree not to copy materials on the site, reverse engineer or break into the site, or use materials, products or services in violation of any law. The use of this website is at the discretion of Runwild Agency and Runwild Agency may terminate your use of this website at any time.

 

Compliance with laws

You must abide by all Federal, State and local laws. If you are outside the United States you must comply with all local laws with respect to your online conduct, as well as the export of data to the United States or to your country or residence.

 

Indemnification

You agree to indemnify and hold Runwild Agency, its subsidiaries, affiliates, licensors, content providers, service providers, employees, agents, officers, directors, and contractors (the “Indemnified Parties”) harmless from any breach of this Agreement by you. You agree that the Indemnified Parties will have no liability in connection with any such breach or unauthorized use, and you agree to indemnify any and all resulting loss, damages, judgments, awards, costs, expenses, and attorneys’ fees of the Indemnified Parties in connection therewith. You will also indemnify and hold the Indemnified Parties harmless from and against any claims brought by third parties arising out of your use of any content or information or service accessed from this Site.

Use of Information

Runwild Agency reserves the right, and you authorize us, to use and assign all information regarding site uses by you and all information provided by you in any manner consistent with our Privacy Policy.

 

Copyrights and Copyright Agent

If you believe your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have otherwise been violated, please provide a notice containing all of the following information to our Copyright Agent:

Applicable Law

You agree that the laws of the state of California, without regard to conflicts of law provisions will govern these Terms and Condition of Use and any dispute that may arise between you and Runwild Agency or its affiliates.

 

Severability

If any provision of this Agreement shall be adjudged by any court of competent jurisdiction to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this Agreement will otherwise remain in full force and effect.

 

Waiver

The failure of Runwild Agency to exercise or enforce any right or provision of this Agreement shall not operate as a waiver of such right or provision. Any waiver of this Agreement by Runwild Agency must be in writing and signed by an authorized representative of Runwild Agency.

 

Termination

Modification and Termination of the Website. Runwild Agency reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the website or any service provided by the website (or any part thereof) with or without notice. You agree that Runwild Agency will not be liable to you or any third party for any modification, suspension or discontinuance of the website or any service.

 

Relationship of the Parties

Nothing contained in this Agreement or your use of the Site shall be construed to constitute either party as a partner, joint venturer, employee or agent of the other party, nor shall either party hold itself out as such. Neither party has any right or authority to incur, assume or create, in writing or otherwise, any warranty, liability or other obligation of any kind, express or implied, in the name of or on behalf of the other party, it being intended by both parties that each shall remain independent contractors responsible for its own actions.

 

Entire Agreement

This Terms of Use constitutes the entire agreement between you and Runwild Agency and governs the terms and conditions of your use of the Site, and supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between you and Runwild Agency with respect to this Site. Notwithstanding the foregoing, you may also be subject to additional terms and conditions, posted policies (including but not limited to the Privacy Policy), guidelines, or rules that may apply when you use the website. Runwild Agency may revise this Terms of Use at any time by updating this Agreement and posting it on the Site. Accordingly, you should visit the Site and review the Terms of Use periodically to determine if any changes have been made. Your continued use of this website after any changes have been made to the Terms of Use signifies and confirms your acceptance of any such changes or amendments to the Terms of Use.

Privacy Policy

Introduction
  1. Web Site Owner. Runwild Agency, LLC (“Runwild”) is the owner of this web site (“Runwild Web Site”). Runwild can be contacted by mail at 6450 W Sunset Boulevard, Box 1037, Los Angeles, California 90028, by phone at (213) 786-9453, or by e-mail at webadmin@runwildagency.com. This online privacy notice discloses Runwild information practices for this Runwild Web Site, including what type of personal identifiable information is requested in order to make a purchase, how the information is used, and with whom the information is shared.
  2. Anonymous Web Site Visits. In general, you can visit on the Runwild Web Site without disclosing any personal information. Runwild does not keep track of the domains from which people visit us.
  3. Web Site Transactions. At times, Runwild will need personal information regarding a customer or a prospect. For example, to process an order or provide a subscription, Runwild may need to know a customer’s name, mailing address, e-mail address and credit card details. It is Runwild’s intent to inform you before Runwild collects personal information, such as user’s name and/or address on the Internet. If you tell us that you do not wish to have this information used as a basis for further contact with you, Runwild will respect your wishes.

 

Personal Information That May Be Collected
  1. Identifying Information. In order to access designated subscriber services and/or restricted areas within the Runwild Web site, Runwild will request a user to provide certain personal identifying information, which may include: name, postal address, e-mail address, telephone number, facsimile number, method of payment, and, if applicable, credit card number. Runwild may request additional information necessary to establish and maintain customer’s account.
  2. Service Quality Monitoring. Some Web site transactions may require a customer to telephone Runwild, or Runwild to call the customer. Runwild will not contact you by telephone without your prior consent, except to confirm an order placed online and/or to inform a customer of the status of such order. Customer should be aware that it is Runwild’s practice to monitor, and in some cases record such calls for staff training or quality assurance purposes.
  3. Information from Children. Runwild does not sell products or services for purchase by children, and will not collect or post information from a child under the age of 18 without the involvement of a parent or guardian. Runwild will notify the child’s parent or guardian at the e-mail address provided by the prospective customer, alerting the parent or guardian to the child’s use of the Web site and providing instructions as to how the parent or guardian can delete the child’s registration from the Web site.
  4. Lost or Stolen Information. If a customer’s password is lost or stolen, the customer should promptly notify Runwild in order to enable Runwild to cancel the lost or stolen information and to update its records with a changed password.
  5. Chat Rooms, Forums and Bulletin Boards. If customer participates in a Runwild chat room, discussion forum, or posts messages to an Runwild bulletin board, customer should be aware that the information disclosed and shared will be broadly available to other persons, both inside of and/or outside Runwild, who have access to that chat room, forum or bulletin board. Some individual Runwild chat rooms, forums or bulletin boards have additional rules and conditions regarding participation. Also, participant’s expressed opinion is his or her own and should not be considered as reflecting the opinion of Runwild.
  6. Links to Other Web Sites. An Runwild Web site may contain links to other web sites. Runwild is not responsible for the privacy practices or the content of those other Web sites.

 

Uses Made of the Information
  1. Limited Uses Identified. Without customer’s prior consent, Runwild will not use your personal identifiable information for any purpose other than that for which it is submitted. Runwild uses personal identifiable information to reply to inquiries, handle complaints, provide operational notices and in program record-keeping. Runwild also processes billing and business requests related to Runwild Web Site participation.
  2. Marketing Uses. Unless customer marks an “x” on the opt-out option box herein provided, Runwild reserves the right to provide customer with information about Runwild’s Web site, Runwild products and services, and related information in which customer has indicated an interest.
  3. Stored Information Uses. Runwild stores the information entered on the Runwild Web site. Stored information is used by  Runwild and Runwild agents: to support customer interaction with the Runwild Web site; to deliver customer purchases; and/or to contact customer again about other Runwild services and products.
  4. Online Advertising. Some companies that help Runwild deliver interactive on-line advertising, such as banner ads, may collect and use information about Runwild’s customers to help Runwild better understand the types of advertising or promotions that are most appealing to Runwild’s customers. After it is collected the information is aggregated so it is not identifiable to a specific individual. If, however, customer would prefer that these companies not collect such information, please mark an “x” on the opt-out option box herein provided.

 

Disclosure of the Information
  1. Within Corporate Organization. Runwild is a multinational organization, with legal entities, business processes, management structures, and technical systems that cross borders. Runwild may share your personal information within the Runwild corporate organization, and may transfer the information to countries in the world where Runwild conducts business. Some countries may provide less legal protection for customer personal information.
  2. Mergers and Acquisitions. Runwild never shares, sells or rents your personal information.
  3. Agents. Runwild employs or engages other companies and individuals to perform business functions on behalf of Runwild. These persons are provided with personal identifying information required to perform their functions, but are prohibited by contract from using the information for other purposes. These persons engage in a variety of functions which include, but are not limited to, fulfilling orders, delivering packages, removing repetitive information from customer lists, analyzing data, providing marketing assistance, processing credit card payments and providing customer services.
  4. Affiliated Businesses. Runwild works closely with affiliated businesses operating web site stores, providing services or selling products on each other’s Web sites. These businesses identify themselves to customers. Customer information related to a transaction with an affiliated business is shared with that affiliated business.
  5. Marketing Analysis by Third Parties. Runwild reserves the right to disclose to third parties personal information about customers for marketing analysis; however, any information disclosed will be in the form of aggregate data that does not describe or identify an individual customer.
  6. Disclosure to Governmental Authorities. Under certain circumstances, personal information may be subject to disclosure pursuant to a judicial or other government subpoenas, warrants or orders.

 

Use of Computer Tracking Technologies
  1. No Tracking of Personal Information. Runwild’s Web Site(s) are not set up to track, collect or distribute personal information not entered by visitors. Through web site access logs Runwild does collect clickstream data and HTTP protocol elements, which generate certain kinds of non-identifying site usage data, such as the number of hits and visits to our sites. This information is used for internal purposes by technical support staff for research and development, user analysis and business decision making, all of which provides better services to the public. The statistics garnered, which contain no personal information and cannot be used to gather such information, may also be provided to third parties.
  2. Use of Cookies. Runwild, or its third party vendors, collects non-identifiable and personal information through the use of various technologies, including “cookies.” A cookie is an alphanumeric identifier that a Web site can transfer to customer’s hard drive through customer’s browser. The cookie is then stored on customer’s computer as an anonymous tag that identifies the customer’s computer, but not the customer. Cookies may be sent by Runwild or its third party vendors. Customer can set its browser to notify customer before a cookie is received, giving an opportunity to decide whether to accept the cookie. Customer may also set its browser to turn off cookies; however, some Web sites may not then work properly.
  3. Use of Web Beacon Technologies. Runwild may also use Web beacon or other technologies to better tailor its Web site(s) to provide better customer service. If these technologies are in use, when a visitor accesses these pages of the Web site, a non-identifiable notice of that visit is generated which may be processed by Runwild or by its suppliers. Web beacons usually work in conjunction with cookies. If customer does not want cookie information to be associated with customer’s visits to these pages, customer can set its browser to turn off cookies; however, Web beacon and other technologies will still detect visits to these pages, but the notices they generate cannot be associated with other non-identifiable cookie information and are disregarded.
  4. Collection of Non-Identifiable Information. Runwild may collect non-identifiable information from user visits to the Runwild Web site(s) in order to provide better customer service. Examples of such collecting include: traffic analysis, such as tracking of the domains from which users visit, or tracking numbers of visitors; measuring visitor activity on Runwild Web site(s); Web site and system administration; user analysis; and business decision making. Such information is sometimes known as “clickstream data.” Runwild or its contractors may use this data to analyze trends and statistics.
  5. Collection of Personal Information. Runwild collects personal identifying information from customer during a transaction. Runwild may extract some personally identifying information about that transaction in a non-identifiable format and combine it with other non-identifiable information, such as clickstream data. This information is used and analyzed only at an aggregate level (not at an individual level) to help Runwild understand trends and patterns. This information is not reviewed at an individual level.

 

Information Security 
  1. Commitment to Online Security. Runwild employs physical, electronic and managerial procedures to safeguard the security and integrity of personal information. Billing and payment data is encrypted whenever transmitted or received online. Personal information is accessible only by staff designated to handle online requests or complaints. All Runwild agents and contractors with access to personal information on the Runwild web site(s) are also bound to adhere to Runwild security standards.
  2. No Liability for Acts of Third Parties. Runwild will exercise all reasonable efforts to safeguard the confidentiality of customer personal information. However, transmissions protected by industry standard security technology and implemented by human beings cannot be made absolutely secure. Consequently, Runwild shall not be liable for unauthorized disclosure of personal information due to no fault of Runwild including, but not limited to, errors in transmission and unauthorized acts of Runwild staff and third parties.

 

Privacy Policy Changes and Opt-Out Rights
  1. Changes to Privacy Policy. This privacy notice was last updated on February 1, 2023. Runwild reserves the right to change its privacy policy statement at any time. A notice of any material change will be posted on the Runwild Web site on page Privacy Policy page. for thirty (30) days prior to the implementation of such change.
  2. Opt-Out Right. Customer has the right at any time to cease permitting personal information to be collected, used or disclosed by Runwild and/or by any third parties with whom Runwild has shared and/or transferred such personal information. Right of cancellation may be exercised by contacting Runwild via e-mail at webadmin@runwildagency.com, telephone or certified postal mail. After processing the cancellation, Runwild will delete customer or prospective customer’s personal information from its data base.

 

Access Rights to Data
  1. Information Maintained by RUNWILD. Upon customer’s request, Runwild will provide a reasonable description of customer’s personally identifiable information that Runwild maintains in its data bank. Runwild can be contacted by e-mail at webadmin@runwildagency.com, telephone at (213) 786-9453, or certified postal mail at 6450 W Sunset Boulevard, Box 1037, Los Angeles, California 90028.
  2. Corrections and Changes to Personal Information. Help Runwild to keep customer personal information accurate. If customer’s personal information changes, or if customer notes an error upon review of customer information that Runwild has on file, please promptly e-mail Runwild at webadmin@runwildagency.com and provide the new or correct information.
  3. Your California Privacy Rights. Beginning on January 1, 2005, California Civil Code Section 1798.83 permits customers of Runwild who are California residents to request certain information regarding Runwild’s disclosure of personal information for their direct marketing purposes. To make such a request, please write to: webadmin@runwildagency.com. Within 30 days of receiving such a request, Runwild will provide a list of the categories of personal information disclosed to third parties for third-party direct marketing purposes during the immediately preceding calendar year, along with the names and addresses of these third parties. This request may be made no more than once per calendar year. Runwild reserves its right not to respond to requests submitted other than to the address specified in this paragraph.California’s privacy laws require a company to provide notice to California users of their rights to receive information on to which entities their information was shared for marketing purposes.
